Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Sam Ships, the independent app studio that operates Daily Mahj (“Daily Mahj,” “Sam Ships,” “we,” “us,” or “our”). They govern the Daily Mahj mobile app, optional accounts, Friends and leaderboard features, subscriptions, websites, support, and related services (collectively, the “Service”).

By downloading, purchasing, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be legally capable of entering these Terms. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to them for you. Optional account and Friends features are not intended for children under 13 to use independently.

Daily Mahj is a solitaire-style American Mahjong puzzle game. Features may include daily puzzles, replayable collections, an archive, local progress, streaks, virtual coins or chips, cosmetics, sharing, optional profiles, invite codes, Friends, leaderboards, referral rewards, and Daily Mahj Pro.

Daily Mahj is an entertainment product, not an official rules authority, competition adjudicator, gambling service, financial product, or promise of a particular outcome. Puzzle availability, scoring, par, rewards, and features may change as the Service evolves.

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use Daily Mahj on Apple-branded devices you own or control, as permitted by the Apple Media Services Usage Rules. The app is licensed, not sold.

Apple's Standard Licensed Application End User License Agreement (“Apple Standard EULA”) also applies. These Terms supplement it for the Service, subscriptions, optional accounts, and our relationship with you. If they conflict about the app license, the Apple Standard EULA controls to the extent of the conflict.

Daily Mahj Pro may be offered as monthly and annual auto-renewable subscriptions. The exact product, duration, localized price, trial or introductory offer, and included features are shown in the app and Apple's purchase sheet before confirmation. The Apple purchase sheet controls if another displayed transaction term conflicts with it.

• Payment is charged to your Apple Account when confirmed.
• A subscription automatically renews for the displayed period unless canceled at least 24 hours before the current period ends. Apple may charge for renewal within 24 hours before that end.
• If a trial is offered, Apple determines eligibility and it converts to a paid subscription unless canceled before it ends.
• Manage or cancel through Apple subscription settings. Deleting Daily Mahj or an optional account does not cancel a subscription.
• Use Restore Purchases to restore an eligible entitlement.
• Apple processes billing and refunds under its policies. Except where law requires otherwise, charges are nonrefundable and we do not provide partial-period credits.
• Prices and subscription features may change. Apple will provide or require notice and consent where applicable.

Daily Mahj Pro must provide ongoing value, but individual collections, cosmetics, archive items, and benefits may be added, changed, replaced, or removed over time, subject to applicable law and Apple's subscription rules.

Daily Mahj may award virtual coins or chips, tile themes, avatars, badges, streak savers, or similar items (“Virtual Items”).

• Virtual coins or chips are earned through gameplay or referrals and are not sold for money.
• Virtual Items have no cash value, are not legal tender or property, cannot be redeemed for money or real-world goods, and cannot be sold, transferred, or exchanged outside the Service.
• Virtual Items are a limited, revocable feature license. We may adjust earning rates, prices, balances, availability, or functionality to operate and balance the game, subject to law.
• We may correct balances or remove rewards obtained through error, automation, manipulation, fraud, or violation of these Terms.

Daily Mahj does not permit betting or wagering and does not convert Virtual Items to or from real money.

Creating an account through Sign in with Apple is optional. It can enable profiles, Friends, invite codes, leaderboards, synchronized streak records, and referral rewards. You must provide accurate information, secure your Apple Account, and notify us of suspected unauthorized access.

Your display name, avatar, invite code, and relevant results may be shown to accepted Friends or a signed-in player who enters your exact invite code. You are responsible for the invite codes and profile information you share.

You may remove Friends, sign out, or delete your account in the app. Account deletion removes associated server records as described in the Privacy Policy, but does not automatically delete local gameplay or cancel an Apple subscription.

“Your Content” means a display name, profile selection, support message, feedback, shared result, or other material you provide. You retain your rights in it and grant us a limited, non-exclusive, worldwide, royalty-free license to host, copy, transmit, display, and process it only to operate, secure, support, and improve the Service, enforce these Terms, and comply with law. The license ends when content is deleted, except for limited backup, legal, or security copies.

You agree not to:

• Impersonate another person or use misleading, abusive, hateful, obscene, infringing, or unlawful content.
• Harass, threaten, exploit, or collect data about another player.
• Share another account holder's invite code without permission.
• Access another account or nonpublic system, scrape the Service, probe security, bypass limits, automate requests, or interfere with the Service or another person's use.
• Manipulate results, referrals, streaks, purchases, entitlements, or Virtual Items.
• Reverse engineer, decompile, modify, or create derivative works of the app, except where law expressly permits despite this restriction.
• Use the Service unlawfully, infringe another person's rights, or use it commercially without written permission.

We may remove content, reverse improper rewards, restrict social features, or suspend access when reasonably needed to enforce these Terms, protect the Service, or comply with law.

Daily Mahj can open the system share sheet for scorecards or text. You choose the destination and are responsible for reviewing the material and having the right to disclose it. Recipients and third-party apps handle it under their own terms and privacy policies.

The Service, including its software, puzzle content and compilation, artwork, design, text, branding, and other materials, is owned by Sam Ships or its licensors and protected by intellectual-property laws. Except for the limited license above, no rights are granted.

If you provide suggestions or feedback, you grant us a perpetual, worldwide, royalty-free right to use it without restriction or compensation, provided we do not publicly identify you as its source without permission.

Our Privacy Policy explains how information is handled. By using optional account, purchase, update, or sharing features, you direct us and the identified providers to process information as described there.

The Service relies on Apple, RevenueCat, Supabase, Expo, Google, and other infrastructure providers. Their services may have separate terms and privacy policies. You must comply with applicable third-party terms, including Apple's terms and your wireless or internet agreement. We are not responsible for third-party services outside our reasonable control.

We may provide app updates, including compatible over-the-air updates, that add, change, or remove features, correct errors, adjust puzzles or rewards, or address security and legal needs. Some updates may be required for continued use.

We do not promise that every puzzle, leaderboard, streak, account, subscription feature, or other part will always be available or error-free. We may modify, suspend, or discontinue parts of the Service, subject to law and obligations for paid subscriptions.

You may stop using the Service at any time and must separately cancel an active Apple subscription to stop renewal. We may suspend or terminate optional account or social access for a material violation, security or legal risk, fraud, abuse, or discontinuation. Where practical, we will provide notice unless immediate action is needed.

Provisions that by nature should survive—including ownership, Virtual Items, disclaimers, liability limits, indemnity, dispute terms, and general provisions—will survive termination.

To the maximum extent permitted by law, the Service is provided “as is” and “as available,” with all faults and without warranties of any kind. Sam Ships disclaims express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, quiet enjoyment, and warranties arising from course of dealing or usage of trade.

We do not warrant uninterrupted, secure, or error-free operation; preservation or accuracy of puzzles, scores, rankings, rewards, or results; or that every feature will meet expectations. Local data can be lost through device loss, storage clearing, app deletion, software error, or failed backup. Non-waivable consumer rights remain unaffected.

To the maximum extent permitted by law, Sam Ships and its owner, affiliates, licensors, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, profits, revenue, goodwill, or opportunity; or substitute service costs arising from the Service, even if advised of the possibility.

To the maximum extent permitted by law, their total aggregate liability for claims related to the Service will not exceed the greater of (a) what you paid for Daily Mahj during the 12 months before the event or (b) US $100. This does not limit liability that cannot lawfully be limited, including fraud, intentional misconduct, or certain personal injury claims.

To the extent permitted by law, you will defend, indemnify, and hold harmless Sam Ships and its owner, affiliates, and licensors from third-party claims, damages, and reasonable costs arising from your unlawful use, Your Content, or material violation of these Terms. This does not apply to the extent a claim was caused by Sam Ships or where prohibited by consumer law.

Before filing a claim, you and Sam Ships agree to send a written description of the dispute and requested relief to the contact below and attempt in good faith to resolve it for 30 days. Either party may seek urgent injunctive relief when needed to prevent immediate harm.

These Terms are governed by Colorado law, without regard to conflict-of-law rules, except where the law where you live requires otherwise. Subject to non-waivable consumer rights and eligible small-claims proceedings, state and federal courts with jurisdiction in Colorado have exclusive jurisdiction. Consumers outside the United States retain mandatory protections and court access provided by their local law.

You and Sam Ships acknowledge and agree that:

• These Terms are between you and Sam Ships, not Apple; Sam Ships is responsible for Daily Mahj and its content.
• Sam Ships is responsible for required maintenance and support; Apple has no support obligation.
• If Daily Mahj fails to conform to an applicable warranty, you may notify Apple and Apple may refund the licensed app purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation.
• Sam Ships, not Apple, addresses product, regulatory, consumer, privacy, and intellectual-property claims relating to Daily Mahj.
• You are not located in a U.S.-embargoed or terrorism-supporting country and are not on a U.S. prohibited or restricted party list.
• You must comply with applicable third-party terms.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-specific provisions upon acceptance.

We may update these Terms as the Service or law changes. We will post the revision here and update the date. Material changes receive additional notice or renewed agreement where required and apply prospectively. If you disagree, stop using the Service and cancel any subscription you do not want renewed.

These Terms, the Privacy Policy, Apple Standard EULA, and purchase terms are the entire agreement about the Service. An unenforceable provision will be enforced to the maximum lawful extent and the rest remains effective. Failure to enforce is not a waiver.

You may not assign these Terms without consent. We may assign them in connection with a reorganization, financing, sale, or transfer. Neither party is liable for delay caused by events beyond reasonable control. These Terms create no agency, employment, partnership, or joint venture.
